Any estimate provided by Goleta Fence and Deck, whether verbal or in writing, is based on the information available at the time of assessment. Estimates are not binding until formalized in a signed written contract. Final pricing may differ from an initial estimate if site conditions, material availability, permit requirements, or project scope change after the estimate is issued.
We will notify you in writing of any material changes to cost or scope before proceeding with affected work. No work beyond the agreed scope will be performed without your prior written authorization.
Project start dates are scheduled at the time a signed contract and any required deposit are received. Scheduled dates may be affected by permit review timelines, HOA approval processes, material lead times, or weather conditions beyond our control. We will communicate any delays promptly.
If you need to cancel or reschedule a project, please notify us in writing as soon as possible. Cancellation terms - including any forfeiture of deposits - are specified in your signed project contract. Cancellation of permitted work may result in permit fees that are non-refundable regardless of cancellation terms.
We reserve the right to cancel or suspend work if site conditions are found to be unsafe, if required permits cannot be obtained, or if payment obligations are not met per the contract schedule.
Payment schedules are outlined in your signed project contract. Typical arrangements include a deposit at contract signing, progress payments tied to project milestones, and a final payment upon completion and your acceptance of the work. Payment is due per the schedule set forth in the contract unless otherwise agreed in writing.
Invoices not paid within the timeframe specified in the contract may accrue interest at the maximum rate permitted under California law. If collection action is required, you agree to pay reasonable attorney fees and collection costs in addition to the outstanding balance.
Goleta Fence and Deck reserves the right to place a mechanic's lien on the property in accordance with California law if payment obligations are not fulfilled.
For projects requiring building permits, Goleta Fence and Deck will apply for and manage the permit process on your behalf as agreed in the project contract. Permit fees are passed through to the customer and will be itemized in the written proposal. You are responsible for ensuring that your property's HOA (if applicable) approvals are obtained prior to permit submission, unless otherwise specified in the contract.
Goleta Fence and Deck will not perform work that knowingly violates applicable building codes or local ordinances. If you request modifications to a project that would cause a code violation, we reserve the right to decline those modifications.
Goleta Fence and Deck warrants that all work will be performed in a workmanlike manner consistent with applicable building standards for the Santa Barbara County region. Specific warranty terms for labor and materials are stated in your signed project contract.
Material warranties are subject to the terms of the respective manufacturer. Goleta Fence and Deck does not extend manufacturer warranties beyond their stated terms. Warranty coverage does not apply to damage resulting from misuse, alterations, neglect, acts of nature, or failure to follow recommended maintenance procedures.
The website and its content are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by California law, Goleta Fence and Deck shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of this website or the services provided, including but not limited to lost profits, loss of use, or property damage not directly caused by our workmanship.
